Thank you for visiting Voicedrop. By accessing and utilising our services, you agree to comply with and be bound by the following terms and conditions.

Please review these terms carefully before engaging with our services. If you do not agree to these terms, then you may not use our services.

Definitions

  • Client: The business or individual (with ABN ) engaging Voicedrop’s services.
  • Voicedrop: The service provider offering automation and communication services. Operated by Hillenbrand Family Trust T/A Voicedrop, ABN 64 807 971 603.
  • Referred Prospect: The prospect being referred to Voicedrop’s Clients.

Services Provided

Voicedrop primarily provides infrastructure and automation services for inbound and outbound communication. This includes voice messaging and notifications to facilitate customer engagement and marketing activities.

Our services are designed to assist clients in automating their communication processes effectively and efficiently.

Prospecting Lists

Clients must ensure that the prospecting lists comply with all relevant laws and regulations.

Remuneration

Voicedrop is remunerated primarily on a successful marketing referral basis. Voicedrop gets paid 12.5% (+GST) of the upfront commission received by the client directly relating to the referral introduced by Voicedrop to the client. For example:

  • Real Estate Agents: This refers to the gross commission amount received by the client under the listing contract.
  • Mortgage Brokers: This relates to any upfront commissions received by the loan provider as a result of any loan settlements pertaining to the referred prospect.
  1. Cost of Sourcing Lists: Clients are responsible for paying the costs associated with sourcing lists where leads have opted in to be contacted.
  2. Network Traffic Costs: Clients must pay for the traffic costs incurred by sending and receiving voicemails, notifications, and similar charges. Voicedrop passes through all gross incurred costs without adding any margin. Voicedrop may invoice traffic costs on a monthly basis, and it is to be paid within 7 calendar days.

No Fixed Service Fees

Our automation services are offered without direct service fees. Voicedrop may be compensated through commission-based arrangements as outlined above.

No Guarantee of Specific Outcomes

While Voicedrop endeavours to provide effective automation services, we do not guarantee specific financial outcomes, performance, delivery success, or customer response rates. The effectiveness of the services can vary based on several factors, including market conditions, network limitations and client-specific circumstances.

Onboarding Process

Voicedrop is committed to ensuring a smooth and effective onboarding process. The onboarding process includes a clear introduction to services, account setup assistance, and initial training and support

Client Responsibilities

Clients are fully responsible for complying with all regulatory requirements regarding unsolicited marketing communications. This includes adherence to laws and regulations governing telemarketing and consumer protection.

Indemnification

Clients agree to indemnify and hold harmless Voicedrop from any claims, damages, or liabilities arising from the use of our services. This includes any legal actions related to unsolicited marketing activities conducted by the client using our services.

Real Estate Agent Reporting Obligation

Real estate agents have a reporting obligation to inform Voicedrop of any property listing contract entered into with Referrred Prospects generated by Voicedrop. All inbound calls from Voicedrop to the Client are to be considered a Referred Prospect.

Client Reporting Obligation

Clients are required to report each contractual engagement, such as a property listing agreement with a Referred Prospect within a 7-day period. This ensures transparency and accurate tracking of service performance, referrals and commissions.

Reasonable Basis Approach

Voicedrop employs a reasonable basis approach in providing its services. This means we make all efforts to ensure that our services are effective and suitable for our clients’ needs based on the information provided. However, we do not guarantee specific outcomes. 

User Conduct and Obligations

By using Voicedrop, you agree to:

  • Not engage in any fraudulent, abusive, or illegal activities.
  • Maintain the confidentiality of your account information and notify us immediately of any unauthorised use of your account.
  • Use the service only for lawful purposes and in compliance with all applicable laws and regulations.

Service Levels

Voicedrop offers support primarily via email during weekdays. We strive to respond to all inquiries within one business day and provide the necessary assistance to ensure effective use of our services.

Termination of Service

Either party may terminate this agreement with a 60-day written notice. Any new listings generated by Voicedrop is still covered by this agreement in full and any commissions is payable to Voicedrop even after the termination notice window of 60 days.

Voicedrop reserves the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these terms or is harmful to other users of the service, us, or third parties, or for any other reason. You may terminate your account at any time by contacting our support team in writing. Upon termination, you must cease all use of the service and any outstanding payments will remain due.

Dispute Resolution

Any disputes arising out of or relating to these terms or the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Queensland, Australia, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.

Data Protection and Security

We implement appropriate technical and organisational measures to protect the personal data we process. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security or access. You have the right to access, correct, or delete your personal data held by us. To exercise these rights, please contact our support team.

Service Availability and Maintenance

We strive to maintain the availability of our services and provide advance notice of any planned maintenance. However, we do not guarantee uninterrupted access and are not liable for any downtime or service interruptions that may occur.

Intellectual Property Rights

The content, graphics, design, compilations, and other materials related to our website and services are protected under copyright and other property laws. The use of our website or services does not grant you any licence or right to our content, trademarks, or copyrights.

Accuracy of Information

While we strive to ensure the accuracy and reliability of the information provided through our services, Voicedrop does not warrant that all information is complete, accurate, or up-to-date. Information may contain errors or omissions, and we recommend clients verify any information upon which they plan to rely.

Limitation of Liability

Voicedrop will not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services or any information provided on our website. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if Voicedrop has been advised of the possibility of such damages.

Amendments to Terms

Voicedrop reserves the right to modify these terms at any time. We will notify users of any changes by updating the terms on our website. Your continued use of our services after any such changes constitutes your acceptance of the new terms.

Access and Use

By agreeing to these Terms of Service, you confirm that you are using our services in compliance with all applicable laws and regulations.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time. All data transfers may occur over various networks and may be adjusted to conform to technical requirements.

Modifications to the Service

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

Third-Party Links and Services

Certain content, products, and services available via our Service may include materials from third parties. We are not liable for any harm or damages related to the purchase or use of goods, services, or any transactions made through any third-party links or referrals to other services.

Personal Information

Your submission of personal information through the site is governed by our Privacy Policy.

Errors, Inaccuracies, and Omissions

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information if any information on the Service or on any related website is inaccurate at any time without prior notice.

Disclosure of Affiliate Relationships

We may receive a fee for referring users to third-party services. This referral fee does not impact the integrity of our recommendations.

Email Communication Clause

The parties agree that email communication is accepted as a legal form of communication under this agreement. Both parties agree to maintain accurate and current contact details at all times to ensure effective communication.
